Legal Question in Wills and Trusts in Texas

injury of minor out of state

We live in Texas. We were visiting family in MD this summer when due to negligence on the part of the homeowner, my 4 year old son fell 12 feet to the ground. The homeowners insurance company has accepted complete responsibility for all bills and a settlement. The settlement amount is still in negotiations. What I need to know is...since the accident happened in MD but we do not live there the money does not have to go into a trust. But what are the laws in Texas and are they reciprocal? I obviously want to put this money where I see fit...that being into current college funds we have and educational tuition that will be forthcoming. I do have an attorney in MD but Texas is what I need to know. Thanks

Since the settlement is to a minor, the money will have to go into a trust where it will held until the minor is 18 year of age. This is actually more of a "personal injury law" question than a trusts question, since personal injury lawyers handle those matters all the time.
