My ex-wife and I had a insurance policy together called a first to die policy. Upon the first persons death the beneficiary named in the policy get the life insurance proceeds. Eventhough we divorced we left the beneficiaries the same. My ex has passed away, am I still entitled to the insurance proceeds? I have been paying for the policy since divorced and I have paid for it for over 10 years now.

Did you re-establish the beneficiaries after the divorce? If you didn't, and just let it remain, you are probably out.

Although my firm does a number of life insurance cases, I can't answer this without getting a lot more information from you. Was the policy mentioned in the divorce, or was it part of a QDRO? Did you re-affirm the policy after the divorce? Was the policy part of a work provided benefit? Was there a written agreement between you and your ex? As you can tell, these types of cases are very fact specific. Many firms (mine included) will meet with you for free to see if there is anything that can be done.
