Intestate Death of Father in Texas

My daughter's father died in Texas without a will. She has received documentation indicating the wife has applied to be executor of his estate. My daughter is an adult and she does have a brother. What happens if they don't sign the documentation? What rights do they have as adult children?

You didn't state what the document is, so I can't tell you what it means. To answer your other question, assuming the father didn't have a will, the surviving spouse and the children each get a share of the estate. If your daughter is an adult, she can appear and participate in the court proceedings.

Your daughter has the right to inherit a portion of her father's estate equal to her brother's in the real property and personal property. If this amounts to something she might consider significant, she might hire an attorney.
