Joint Wills

My mom and dad had a joint will. Only one legal instrument for both of them, each leaving the entirety of their assets to the survivor. After both are gone, the remainder is 50/50 between my brother and myself. We did not have the will probated after my father died. Do you think it should be probated, or can we wait until both executors of the will are deceased.

You need to probate the will after a death. There is a four year statute of limitations. How long ago was your father's death?
