Legal Question in Wills and Trusts in Texas

land inheritance

three brothers and an uncle own a piece of land,2 brothers live in fort worth, one in arkansas and uncle lives in Overton, Texas. brothers can not contact uncle because he is trying to avoid them. there is a strong possiblity that uncle has hired a lawyer and sold the land and spending the money. What preperations are needed to approach this correctly. In a month or so we are traveling to Overton to find and talk to him.

Re: land inheritance

Check the real property records in the county where the property is located. That will tell whether the property has been sold, to whom, and how your uncle may have sold more than his undivided 1/4. If he's sold the property outright, contact the buyer and let them know that they only bought an undivided 1/4, then hire a lawyer to proceed.

Re: land inheritance

I don't know how uncle could sell the land with three other brothers on the deed. Are they on the deed? Are they in the chain of title as an inheritance. The uncle could not sell what is not his and the buyers could not buy what is not for sale. You need to get more facts. If indeed he somehow transferred something, you need to find out how he did it.
