It depends on the license agreement. For tenants, the landlord has a duty, upon actual notice, to make a diligent effort to repair or remedy any condition which materially affects the physical health or safety of an ordinary tenant. There is no duty to repair if the condition was caused by the tenant, the tenants, family, guests, or invitees during the term of the rental agreement.
