What are the laws concernig property when one has medicare and medicaid? Does Texas law say that the state will keep the property once one passes away?

MediCARE is a program for over individuals over 65, and usually the state will not touch your estate's property, unless there is an injury for which a third party was responsible, and you recover from them. (For example, if the Medicare subscriber was injured in a car accident, and the at fault party paid for medical bills that Medicare paid for.)

MediCAID is a program for indigent care, and the state can attach some property, if the estate is not properly planned. If you are getting on Medicaid, you should speak with a Medicaid planner IMMEDIATELY. Feel free to call me if you have questions.
