my lawyer avoids me

My brother and I have been dealing with a lawyer for over a year now after the death of my mother. He has a simple task: get the medical records of my mother for the period of the last year of her life. My sister has p.o.a. and she is hostile to the idea. (She is a nurse and doesn't want to upset the medical establishment.) However, this attorney has promised to get the medical records, and I gave him p.o.a. to do such. He had my sister sign an agreement that she would not protest a court injunction by me or my brother to access the medical records in exchange for my brother and me not interfering with the probate of the will. That was in April, and that was the last time I payed him anything. Since then he refuses to answer my countless telephone calls. Is he being dishonest? Should I get another attorney? Or talk to him frankly about this? I can't understand how he can avoid answering literally dozens of telephone calls to the receptionist and also voicemails.

You can report this behavior to the Stare Bar. www.texasbar.com. I would hire another lawyer and go forward. Be sure and check your new lawyer out.
