Legal Question in Wills and Trusts in Texas

Lawyer and Probate

As an executor named in a will, do I have to have a lawyer to go to court to probate a will and does this ''probating the will'' allow me to have access to my Aunt's bank account to pay off her debts?

By the content of your questions, yes, you do need an attorney to help you through the probate procedure. As part of the probate you will be formally accepted by the Court as the Executor of the Estate and receive Letters Testamentary. It is the Letters Testamentary that prove your authority to others and allow you to deal with banks and creditors.
