Legal Question in Wills and Trusts in Texas

Legal Steps to make Co-Trustee comply with Directives of Trust

My step-mother and I are Co-Trustees of my father's trusts.

She has been operated soley, and represented herself as the only Trustee. I have written a demand letter for full disclosure and documentation, plus hired an attorney. The deadline is past by two months and I can't get the attorney to take any legal action to enforce the demands. All decisions are to be made by us together as Co-Trustees. She has been liquidating assets and co-mingling funds. Where do I go from here?

Find out why your attorney hasn't been able to get matters sorted out. If the answer isn't satisfactory, get another attorney that can get it sorted out.

If she is liquidating assets, you need to act quickly. Be sure you have a copy of the trust, take it to another attorney, and get to court!

Fire your attorney and get another one that will actually take some action. What is their excuse when you call for this kind of delay? How much did you pay him/her? I'd ask for a refund too since he/she is causing you to lose your rights by sitting on them. If they balk, tell them you might refer the matter to the state bar if they don't. I'm tired of seeing people get hurt by poor lawyering.
