Legal Question in Wills and Trusts in Texas

Legality of a destroyed will

My aunt passed away last year. A few years ago, she took her will and cut off the portion naming the heirs. She never made a new will. There are no other copies of the will. The portion that was removed was thrown away. Her husband's will was supposedly identical to hers with regard to heirs(he died several years before she did and his will was probated). Can her will be submitted for probate, using a copy of his will to show intent, with regard to heirs?

You need to talk to a good probate attorney in the county where your aunt lived. Sounds like your aunt died without a valid Will.
