Letters Testimentary - Texas
Mother passed. We have simple will of estate less than $80,000, no property at all, death certificate, need to get money from financial company(s) and they want Letters Testimentary. Can we get a form and present in court ourselves without a lawyer? Thanks.

Of course you can. I'm sure you will read up on the requirements of the Probate Code, and the necessity to provide the proper evidence to obtain the letters and the proper language required. Nothing to it. I wonder why all those lawyers go to law school to study that stuff. Good Luck.

See if they will accept an affidavit of heirship instead. If not, you will need to contact an attorney to probate the will.

The normal fee for probate is $1500 plus costs of about $250...and you will have the costs whether you hire a lawyer or not. Call us or shop..yes..one does not need a lawyer..as we don't need plumbers, electricians...but when we mess up it costs more..sometimes we don't mess up..
