letters of testimentory and probate

My husband died with only $300 in a bank account. I am told I ned a letter of testimentory to obtain those funds and to file a joint tax return. It is not worth probating the will as there is nothing else and cost of probate would far exceed any benefits. Is there another way to obtain these letters.

You don't need letters testamentary. You can do it with an affidavit of heirship. If you can't find a decent lawyer around Houston to do this pro bono. Go into Houston to one of the law schools, see if you can talk to one of the professor for Wills and Trusts and see if there is a pro bono project to help people in your situation. If not, contact me on the internet and I'll do it for you for postage. There would still be filing fees to pay at the courthouse - so this is not going to be free.
