Legal Question in Wills and Trusts in Texas

Life estates

In Texas can a beneficiary name be removed from a life estate? The life estate was set up with several children and grandchildrens names and I would like to remove one of the names. Can I remove the name since I set it up or do I need the childs permission ? Thanks for any help.

Re: Life estates

Depends on whether the document granting the life estates has been filed of record or not. If it hasn't been filed or recorded, then you can make whatever changes you want, provided that the gift hasn't already been given.

If you've already given the gift, or filed the life estate deed in the real property records, then undoing the gift may be difficult.
