Legal Question in Wills and Trusts in Texas

Life Insurance

My grandfather recently passed away and left my cousin as trustee. The will states that everything is supposed to be left to my grandfathers 2 daughters (my mom and his mom), but he is dragging his feet and not giving up anything. When reviewing my grandfather's personal files (which we were given access to) we found that he had taken out life insurance policies on his grandchildren and cashed out the value of them after we turned 18 without our knowledge or consent. Do I have a case against the trust to have the cash value of the policy that was stolen in my name returned to me?

Re: Life Insurance

Depending on the terms of the policy, those policies may have still belonged to your grandfather or they may have belonged to you grandchildren. You should find out about that before you consider suing your grandfather's estate. After you have researched this, consult with your attorney to see if you have a case, and whether it would be cost-effective to pursue it.

Re: Life Insurance

Unless the policies named the trust as beneficiary, you would probably not have a claim. If that is the case and you want my assistance in this matter, contact me by email.
