Life Insurance-Beneficiary cont
I was made the beneficiary of policy years ago when it was established. I never asked the name of the company, one poor taste two could not think of friend passing, he was a surrogate father to me and grandfather to my son. You admits to having the policy, will not tell me the name of the company. My son is mentioned in the will, but I do not care about the will. The policy was set up and he asked me to use a portion for something he wanted after he passed away. I can not honor this without the proceeds from the policy. There are other things which I was made POD at the time of his passing, I am not worried about those as well. She cut off other avenues of obtaning the information for the life insurance. The bank will not give me his statements or information on who he paid premiums to, but will let me have the money left in the bank, so that one is a dead end. He specifically said the policy will not be part of his will. I have thought of sending certified letter to show proof of trying to obtain this policy or at least the company name, will this help me if I must take legal action. The policy is only for 10K, she states she wants compensation for cremation, is this not handled by the estate.

You should get a lawyer to send her a letter. You should also see that the will gets probated. Typically, burial expenses are covered by the will. The person holding the will hostage needs to know that there is a legal obligation to get the will to the probate court. You could also subpoena her for a deposition regarding the whereabouts of the insurance policy.
