Legal Question in Wills and Trusts in Texas
Lis Pendens
What is a Lis Pendens ? Can an heir to real estate file it
if there is a problem with settling the estate and does it
have to be done by a lawyer or signed by a judge? Thank You, Ann

Re: Lis Pendens
Lis Pendens notices are merely a "notice" to the world that litigation is pending concerning a particular piece of property, so that all potential purchasers can find out beforehand if they're buying property that really may belong to someone else, in whole or part. Anyone can file one, but wrongfully filing one can get YOU in a lot of hot water. Be careful to make sure your position is righteous before filing a lis pendens notice.
