Legal Question in Wills and Trusts in Texas
I live in Texas and my aunt had a "gift deed" prepared In March 1994 leaving her home to me.This gift deed has a life estate clause included. She lived in the home until she entered a nursing home in Sept of 2006 which Medicaid pays. She will never be able to return to the home and it is deteriorating rapidly. Since the home is technically mine - can it be sold? Would this sale somehow effect medicaid being able to disqualify her ? and would the sale be subject to the medicaid recovery act after she passes?

You really need to have an eldercare attorney look at the document to see where you stand with Medicaid.
