Legal Question in Wills and Trusts in Texas
Living in Texas. My father recently passed. He owned his house prior to remarrying and he had a living trust. He also had a pour over will in which he had moved his house into. What rights to the house does his wife have?
1 Answer from Attorneys
Your father's spouse may have several rights involving the house, including the right to reside there for life if she desires. Beyond the basic homestead rights that the wife likely has, it's impossible for any attorney to answer your question without reviewing the documents that you've identified. If you're at all concerned about this property or protecting any interest that you might have in it, you need to sit down with an attorney to discuss this in detail. Quick responses from the Internet will be of little benefit to you.
