Who can make a claim to an estate?

A man dies intestate in a community property state. Do the children of his (dead) brother have a legal claim to his estate even if their claim will rob the deceased widow of her livelihood?

The widow needs to talk with a good probate/estate attorney. It doesn't seem likely that the nieces and nephews have any claim to the estate.
