Legal Question in Wills and Trusts in Texas

Minor children

I am the grandmother of a 3yr.old and a 7 yr. old whom I have custody of . Their mother died last year and their father lives in jail mental institutions and in the streets.He also is an only child who's father died Jan 23 of this year.There is some money in his estate.There is an older man who is in the home claiming--name removed--be his only relative (uncle)besides the childrens father.He says he has a lawyer and the childrens father will not get anything because he is a drug addict and has mental problems.The problem is there is no will. The two grandchildren I am raising are the deceased's only two grandchildren also. Should't they be heirs after their father.What right does this older man have--name removed--come in and take every thing. Plus I know for a fact the older man is not his only living relative the deceased has a half brother in Alabama.Anyway what can I do if anything--name removed--see about the children not getting their inheirtance stolen from them?

Unfotunately, everything in the estate goes to the children's father if his father died in Texas. His children will inherit whatever is left when he dies. They do not take while he is alive.
