Legal Question in Wills and Trusts in Texas

Mishandled Will

Is there a statute of limitations for legal matters pertaining to a probated will?

Three sisters (my elderly Aunts) and my Uncle, were given one share of oil company stock (to divide equally) at the death of their grandmother in 1957. The gift was outlined in the will, but my Aunt and Uncle were not allowed to attend the reading of the will. The rest of the family was very manipulative in this little town and my Aunts and Uncle never received anything from this bequeath. My Aunt is this last living sibling and wants to get this cleared up before she dies and the record conveniently disappears. The rest of the family has made a great deal of money over the years with this oil company stock. My Aunt knows which oil company is involved. Back in 1957, an attorney leaving the reading of the will told my Aunt ''this is not right'' and advised her to take the will straight to the oil company's law department. She was young then and did not follow-up on this advice.

Do you think it is possible for me to help my Aunt and if so how?

Re: Mishandled Will

You'll have to go to the county where the will was probated and get a copy. Then send a certified copy of the will to the oil company with a letter explaining what's been going on.
