Legal Question in Wills and Trusts in Texas
misrepresentation of power of attorney
my father in law just passed away, and we are coming to find out that his sister in law had him sign power of attorney forms ,last will forms and they all indicate that he was mentally incompetent, which he was not. We went to his place to check out what was left in his place and found important items missing. She filled out a form with social security to recieve his benifits, stating he was mentally incompetent, that he had no one living that was concerned about his well being, and that she was never cjonvicted of a felony. She was convicted of embezallment. We need to know our legal rights in this matter.

Re: misrepresentation of power of attorney
I'm sorry for the sitiation you're in. as heirs of the estate, you are the victims of felony theft. You could immediately make report to the police or sherrif. she has committed a federal felony. You can report this to the Social Security office. The SS office of the Inspector General should work on this. But they have 1000's of cases. If you want to pay an attorney, you can also open a probate case. Good Luck.
