Legal Question in Wills and Trusts in Texas
Mom was a hoarder so when she became ill and drafted her will, my older sister and brother-in-law refused to be her executor. When asked, I accepted, I would do it for Mom. I have two sisters and both have stated for years that when Mom died, we'd just have to get a big dumpster "and throw everything a way!"
Well, I didn't do that. I got two friends of my daughter's and my son and we got in there and sorted and pulled out family treasures and gave stuff to people, called my sisters and nieces and told them to take anything they wanted. Then I had a couple garage sales and made several hundred dollars. Since my sisters had always said they'd just throw everything away, I didn't know one of them would insist on getting her 'share' of the garage sale money.
My question is about money: is my sister entitled to the money I made from the sales when she said everything could be thrown away and was offered to her first? Am I entitled to take my expenses out of the estate? I paid Mom's bills and to clean the yard so I could sell the house and thought I could reimburse myself out of the sale. Can I? Can I pay myself for cleaning the house? It's a large 2,800 sq foot house and it was full of junk. We cleaned for months. I thought I might be able to have something for that or is that just part of being the executor?
Yes, I have a probate attorney but he has not proved good when it comes to returning calls so I need help.
