Legal Question in Wills and Trusts in Texas

Mother died can't find will

My mother passed a way 3/23/05. I know she left a will. My step dad says he can not find the will. I am her only child. How does Texas law view what is legally mine?

Re: Mother died can't find will

it's not unusual for a will to be lost. Unless you know where there is a copy, your mother's estate (1/2 of her community property and separate property, if any) will pass to her heirs according to the Probate Code. That's where you need a lawyer. Good Luck.
