my mother died in 2009 why do we have to PAY a lawyer to probate her will,she left everything equal to her 3 children?

If the will has to be probated (It may not, depending on how your mother's assets were titled and how much they are worth), when you go to court, you will be creating an estate. An estate is a separate entity from you and your brothers and sisters. In order to represent the estate in court, you have to be a lawyer. Some counties allow for a will to be probated as a Muniment of Title by all of the beneficiaries, but that may or may not work for you depending on the assets.
