Legal Question in Wills and Trusts in Texas
Mother passed. Father passed his will was written and recorded in the 70's. Estate to go to 4 children. One child passed before father. So does the estate be divided between the 3 remaining children?

not if the deceased had chilren or other heirs ie a spouse

You need to read the will. It should have specific language that deals with predeceased children. Usually, the deceased child's share goes to the deceased child's heirs.
