Legal Question in Wills and Trusts in Texas

My mother passed away. Her friend was named the executor. She is in ill health and has turned her responsibilites for my mom's well over to me. Do I need to go to court to have anything done leagually to recognized me as the executor of my mom's estate? My mom lived in Forida at the time of her death. Her lawyer is no loger practicing.

Probate must take place where the deceased resided..unless she had a residence in Texas and Florida..but yes, you need to go thru probate to finalize the estate

You need to file an application for probate. The application should be where she owned property. If there's property in Texas, you can file it here. If she's based out of Florida, you should file it there.
