Legal Question in Wills and Trusts in Texas

my mother just passed away 2 months ago and i have 4 other siblings, not all are legal. my brother is saying that because they are not here or dont have their papers that they get nothing. now my mother was not rich but she did have one house on about an acre of land and another half acre somewhere else. i really dont want my other siblings to get left out. is what he said true? also one of my sisters is not here in texas and my brother said for one of us to just sign her name on some papers that give him the land with the house, if we do that can she come back with a lawyer and take it all by stating it was a falsified?

Your brother is wrong. If Mom died without a will, her estate passes according to the LAWS of intestate succession. Any heir who is not present (like maybe in Mexico or another foreign country?) is still entitled to an inheritance.
