Legal Question in Wills and Trusts in Texas
My mother past way 4 years ago and left a will with the 1st page missing. We could not probate the will without the original 1st page, the attorney did a heirship. We divide her investments between the 3 siblings except for her checking account.
She left a house that we cannot sell. When she was alive she was renting it and we all agree to sell the house in the spring of 2010. After being on the market well over a year we cannot sell it and weare using the money in her checking account to make the payment. The money is running out and we had one brother that does not want to rent the house again. He gave us two options #1 was the buy him out at $10,000 (which we cannot afford) or #2 run though mother remaining money and then let the house rot.
My question is if we let the house go back to the mortgage company will it affect our credit? On
the tax appraisal it lists all of us as owner of the property and do not list my mother at all.
Any help will be appreciated.

Is there a mortgage on the house? If so, how much? Also, where is the house located?
