Legal Question in Wills and Trusts in Texas
My mother recently died. She had no debt and her only financial assets are in 2 accounts which I co-owned with her, so I have complete access. My brother and I are the only surviving children and the will gives ecerything to us. I am named the executor.
It seems to us that all we need to do is split the money in the accounts equally. Why would we even need to probate the will?

I would not probate the will under those circumstances...and trust your brother agrees...
