Legal Question in Wills and Trusts in Texas

Hello my mother has a trust which my great-grandmother left her ( she also left me one and seems the same things are happening) and I believe there is a mismanagement issue . She went to the bank just to talk about some things she was curious about and they informed her that her trust only had enough corpus to last for two to three more years and that she had to sell her home which she owns and move to a senior citizens community which she will be paying rent to, and I am really concerned because she wouldnt have known if she just hadnt happened to go to the bank that day. And there are other things that I havent mentioned thats another story all in itself . But I nor she has any money to hire a lawyer and I just feel that it has been mismanaged. I had my trust all of my life and I am now 40 and it terminated at the age of 30 and I had been trying to purchase a home for 15 yrs before it was gone and the trustee wouldnt let me . I was supposed to at 25 be able to withdraw 1/3 of the corpus and at 30 also and that never happened and now its gone thats like what is happening to my mother in a way ,,, I need help... The state is Texas . Can anything be done? Bettye

There are some options. You may be able to interest an attorney to take the case on a contingency basis. Another option would be to contact the attorney general's office.

Many attorneys will help get the trust document for a modest fee...and advise you of your rights. If you all have been living on the trust income there is a good sum, if yu have been using up the principal..it may be all gone. Go to the bank or trustee and make a written demand for a copy of the trust and evidence of its managment over the past ...I have had some give records for 50 years...and the banks change names...But if you are sick you have money for a doctor and it sounds like you are financilly ill...find the modest sum to visit a competent lawyer..

Please have an attorney review the trust and other related documents and he or she will be able to go over options with you. Best of luck.
