Legal Question in Wills and Trusts in Texas

My mother-in-law recently passed away. Her will states that her property is to be shared equally between my husband and his sister. She passed away several years ago. Does this mean he retains full ownership now of mom's property, or is it to be shared between him and his sister's children since she is no longer living?

It depends. The answer depends on the exact terms used in the will.

You should consult an attorney for an in-depth analysis of this situation.

I'm not clear from the question. Has the will been probated? And what is the order of death? From what I can tell, mother in law died first. Then her will was probated. Then sister died. I would have to read the will to tell where the property goes. Most likely, the property would be split between the surviving brother and the heirs of the deceased sister. Again, I don't have any of the facts, so this is wild speculation on my part. Call me if you want me to go over the paperwork with you.
