Legal Question in Wills and Trusts in Texas

mother's ashes

I will be 18 next August. My mother passed away when I was 6 yrs old. Her ashes have been with my aunt (her sister) since then. When I turn 18, do I have the legal right to my mother's ashes? This is something I want very badly so that I can have her ashes laid to rest and have a place to go and ''talk'' to my mom. Do I have rights to this?

Re: mother's ashes

I suppose technically speaking unless your aunt was given responsibility in the wiil, you would be the better person to have custody of your mother's ashes. Have you talked about this? Are responsible enough to take care of your mother for eternity? Some 18 year olds are not. If she will not give you the ashes, then you would have to assert your rights in a lawsuit and that could take a lot of money. Good Luck.
