Legal Question in Wills and Trusts in Texas

my mother's will leaves piece of land to husband, does will need probated? I consulted one atty. he said nothing to probate, her husbands atty thinks there is. I have no argument with her will.

if a will is not probated within 4 years, property goes to heirs as though there was no will..and not knowing the estate/property....I don't know..but land would not be the husbands if not probbated
