Re: Muniment title

From your dates I'm not sure what is going on either. It sounds like the will was probated as a muniment of title. Wills are probated as a muniment of title for two reasons. First it establishes title to real estate, just like a deed. Second, if the will has not been probated within the limitations period, it can still be probated as a muniment of title. Unfortunately, probating a will as a muniment of title does not distribute any assets.

Re: Muniment title

I'm not sure the information was accurate. You cannot probate a will prior to the date of death. Are you sure about your dates?
