Legal Question in Wills and Trusts in Texas

My father died intestate leaving a widow and two biological children. My uncle wants property that belongs to my sister and myself. He should not be involved in any of this and his presence is of a greedy nature. What can I do and does my sister have to side with me to remove him as Administer? Sis won't talk to me and pretty sure he is not interested or wanting to protect our interest. Nothing is filed in probate and says I can not go to the rental house but he has removed everything from the business. How can he do what he is doing and not allow me to ONLY go clean up the yard at the other house? He has no clue what he is doing according to a counsult I went to. I can not afford an attorney, what to do?

If you have no money, you may qualify for free legal assistance. Check with the local bar association. You can act alone to petition the court to remove uncle and allow you to be administrator.

How did your uncle get to be the Administrator? There has to have been a proceeding filed with the probate court for there to be an Administrator. Sounds like this is a mess. To protect your interests (and your sister's) you really need an attorney. This is probably not something you can handle on your own. Good luck!
