Legal Question in Wills and Trusts in Texas

Do oil royalties have to be specifically referenced in a will or is it considered community property. I have royalty income from several different companies and want to make sure it passes easily on to my spouse. The estate would not be subject to any type of federal tax as the royalties are not all that big.

The answer depends on how the royalties were obtained. If you want to ensure they go to your spouse, have a lawyer draw up a will (do not do one yourself.)
