Legal Question in Wills and Trusts in Texas

Out-of-state executor?

I live in Texas, and I want my two sons who live in Colorado to be named co-executors in my will. But my research indicates an executor has to be a resident of Texas. I don't know anyone in Texas I could name as executor - no close friends or relatives here. How would I handle this in my will? My estate will be very small and I want to keep probate expenses to a minimum.

Don't do your will yourself. You'd be surprised how inexpensive it is to have an attorney draft a will for you. It's too easy to mess up a will when you do it yourself. To answer your question, you can have an out of state executor in a will. The exec will have to appoint a registered agent. Many local services will do this for a fee.
