Legal Question in Wills and Trusts in Texas

Need paper showing husband can sign anything for wife after death

Hello Friends,

We recently found out my wife has cancer and a short time to live. Sad as this is, we are fortunate to be able to set some things up. What do we need to have in the line of paperwork showing the husband the legal owner of everything when she passes? We need a document showing where the husband can sign his name on anything in the place of the wifes name. Thank You

You actually need a number of documents. A Will leaving everything to the surviving spouse, a durable statutory power of attorney re business matters, a medical power of attorney (with HIPAA release), a Directive to Physicians (Living Will) and possibly a designation of guardian. NOte that a power of attorney is not valid after a person dies.
