Legal Question in Wills and Trusts in Texas
My parent passed and did not have will and had a townhome. My sibling wants to assume the mortgage on the property. Do I have to draft a document to give my sibling indicating that I have no interest now or in the future in that property?

You first need to establish that the children have an ownership interest in the property. After that, you can either disclaim your interest or transfer your interest to your sibling. This isn't a complicated procedure, but it does need to be done properly. Feel free to call me if you wish to discuss. Specifically, I'll need to know this:
1. The date and location of death
2. Location of the property
3. Whether or not there are any other properties (real or personal)
4. Whether or not there are any debts of the estate
5. Marital and familial history (spouse, children)
