My parents had a mortgage on their home when my father passed on Feb. , 2010.Can Chase mortgage garnish my mother's social security benefits and V.A benefits if she can't pay the mortgage?

Unlikely. There's no direct action to garnish wages or benefits. However, if they foreclosed and there was a judgement of deficiency, etc. then they could attempt to garnish the bank account in which the funds were held. You could fight that, however.

At any rate, call a probate lawyer, many, such as myself, work with investors and banks to get rid of unwanted property.
