Legal Question in Wills and Trusts in Texas

Paying debts without selling inherited house

Our cousin left a small house and personal belongings in her will.We estimate her lien debt to be about 5K and all other debts to be 9K or less after negotiations. We do not want to sell the house in probate. Is there any reason that we cannot loan the estate the money to pay the bills. I am not the executrix. But she has the power to ''obtain loans'' in the execution of her duties. She is not family.Where we live, houses sold in probate get less money, make probate last longer and are hard to sell.We have no need of a hurried sell.

The law doesn't really care who or what pays the debts of the estate. Of course your loan will be a debt to be repaid out of the estate's assets when sold for best value.
