power of attny & executor of the will

Is it legal for the person who has both the POA and who is the executor of the will to sign over land to her nephew the day that my great uncle is in the hospital unconscious and dying? Even when the will says to sell the land not give it away?

Although it's technically legal, it can subject the power holder to a breach of fiduciary duty claim by either the estate or the power grantor. Time isn't on your side.
