Legal Question in Wills and Trusts in Texas

re: Power of Attorney for brother after aneurysm surgery

My cousin who is 59 yrs. old, has never married, no heirs, suffered a brain aneurysm in Sept. 03. After surgery and weeks of recovery the hospital had him moved from ICU to another location after the insurance ran out. He is now in a Rehab Facility and his insurance there runs out Dec. 8, 03. His sister from Califoria has been at his side since it happened. She needs what type of Power of Attorney to pay bills from his account,Dispose of his furniture at his apt., Apply for SSI and Medicaid and to somehow move him back to California so she can find care for him there and be able to work herself. We need answers ASAP. We have all helped as much as possible financially. Thank you ahead of time.

If you will email me directly, I will be glad to provide the form free of charge. However, if your cousin has a house, etc. he may need to do some Medicaid planning if he has assets to preserve. Many attorneys will provide a complimentary initial consultation to discuss the issues.

She needs what is called a Statutory Durable Power of Attorney. That will give her the authority to conduct his business affairs. She may need another when they're back in California.
