Power of Attorney

My brother passed away and he owned a house and some land in texas, He had no kids or wife. So my understanding that in the state of Texas, is that the deceased parent gets 50% and the brotheres and sisters gets 50%. My sister has power of attorney over my mother but will not let us know if it just medical or durable is there a way we can find out which.???

The main worry is when is someone going to do an heirship determination so you can get your share of the estate and make sure the other heirs get theirs. Then Mom's POA will have to be used in Court and you can find out while sorting out the heirship.
