Legal Question in Wills and Trusts in Texas

Prepaid apartment of the deceased

A loved one died recently who had prepaid six months of his apartment lease. The apartment complex is being hard-nosed about enforcing the ''letter of the law'' about the lease, which would allow them to keep 60 days of rent unless they re-let it quicker. Does a death change that?

Re: Prepaid apartment of the deceased

No, not unless so stipulated in the lease. However, if they are able to re-let it, there should be an abatement and refund of some of the rent.
