Legal Question in Wills and Trusts in Texas

Do I absolutely have to probate my late husband's will? He left everything to me, I left everything to him. Everything we have/had was paid for when he died and he left me as his executor. My 15 year old daughter and I are living on his survivor benefits and the majority of that is taken up with utilities, car payment and car insurance - local lawyers charge anywhere from $750 -$1500 to probate a simple will. Can I do it myself, and what forms would I file? HELP!!!

In Dallas County you cannot represent yourself to probate the will. Named Executors, Administrators or persons applying must be represented by legal counsel.

You may not need to probate the will, but you will need to transfer his name off the house and vehicles. Unfortunately, many people try to get out of paying legal fees only to find that it costs much more to fix the issue later.
