Probate or Affidavit

My grandfather died in the late 60s and left my mother and her siblings property in Arizonia and Texas. The heirs never probate the estate. My aunt has been acting as caretaker of the Arizonia land. Whereas, another relative has been caretaking the land in Texas. The Texas land has oil wells and also minerals in which this relative has been collecting. My mother, before she died, left a will naming her heirs. How can we claim our portion of the estate? My grandfather died in Arizonia and my mother in California.

Your mother will need to file a probate proceeding in California under the intestacy laws.

Part of this proceeding will require establishing title to her property interests in the other states.
