Legal Question in Wills and Trusts in Texas

probate

My dad died and he left everything to three children, when he died we had a joint bank account. I have since used our money, will I be liable for any of these funds when the will is probated, or are these funds mine?

It depends how that account was held. If it was joint tenants with right of survivorship, then you're probably ok, i.e. those funds pass to you and are yours when your father passed. If not, you might be liable, you might not. What does the will say? Is everything split equally b/t the three kids? I would advise having a lawyer look at the will and the account to make a final determination. Let me know if I can be of assistance.
